Refund Policy [Updated March 13, 2025]

1. Introduction

This Refund Policy (“Policy”) governs all transactions conducted through Uttkrist Innovations Private Limited (“Uttkrist,” “we,” “us,” or “our”), including payments made via our website, third-party platforms, and direct invoicing. By making a purchase or entering into a contractual agreement with Uttkrist, you (“Customer,” “User,” or “Client”) acknowledge and accept the terms of this Policy.

As Uttkrist collaborates with multiple partners, each with distinct commercial policies, this Policy distinguishes between payments made directly to Uttkrist and payments made to our partners.

2. Non-Refundable Payments to Uttkrist

All payments made directly to Uttkrist are strictly non-refundable and non-reversible, except where required by applicable law. This includes, but is not limited to:

  • Fees for consulting, outsourcing, or distribution services.
  • Software licensing or subscription payments where Uttkrist acts as a distributor.
  • Any digital goods, software access, or services that have been delivered or activated.

Uttkrist does not provide refunds, returns, or exchanges, except where required by mandatory consumer protection laws in jurisdictions where refund rights cannot be contractually waived.

3. Partner-Specific Refund Policies

In cases where a Customer purchases software, services, or subscriptions from a partner or third-party provider through Uttkrist, the refund terms of the respective partner shall apply. Uttkrist does not have authority over partner refund decisions and does not process refunds on behalf of its partners.

Customers are encouraged to review the refund policy of the specific partner on their official website before completing a purchase. Uttkrist disclaims liability for any dispute arising from a partner’s refusal to issue a refund.

4. Consumer Rights Compliance

This Policy is designed to comply with applicable laws in jurisdictions where we operate:

(a) United States

Under U.S. federal and state consumer protection laws, including the Federal Trade Commission (FTC) regulations, a no-refund policy is valid if clearly disclosed before purchase. This Policy complies with those disclosure requirements.

(b) European Union (EU) & United Kingdom (UK)

Under the Consumer Rights Directive (2011/83/EU) and the UK Consumer Rights Act 2015, consumers in the EU and UK may have a statutory right to cancel digital purchases within 14 days. However, this right does not apply once digital content or software is accessed, downloaded, or activated. Uttkrist aligns with this directive by ensuring that customers agree to waive the right to withdraw once services are delivered.

(c) Australia

In compliance with the Australian Consumer Law (ACL) (Schedule 2 of the Competition and Consumer Act 2010), refunds are only required in cases where a product or service is:

  • Faulty, defective, or not as described.
  • Failing to meet consumer guarantees under Australian law.

Uttkrist’s non-refundable policy does not limit a consumer’s rights under ACL for defective services.

(d) India

Under the Consumer Protection Act, 2019, and applicable Information Technology (IT) Rules, Uttkrist’s no-refund policy is enforceable provided it is explicitly disclosed prior to the transaction.

5. Disputes, Chargebacks & Fraud Prevention

Customers agree that initiating a chargeback or dispute with a financial institution does not override this Policy. In the event of an unauthorized transaction or billing error:

  • Customers must notify Uttkrist within 7 days of the transaction date for resolution.
  • If a chargeback is initiated in violation of this Policy, Uttkrist reserves the right to dispute the claim by providing documented evidence of the no-refund terms.

Uttkrist may take legal action against fraudulent chargebacks and reserves the right to recover transaction fees and collection costs.

6. Statutory Exceptions

Notwithstanding the foregoing, refunds may be issued in specific cases where:

  • Required by law.
  • Mandated by regulatory authorities in certain jurisdictions.
  • A separate written agreement exists between Uttkrist and the Customer.

7. Modifications & Updates

Uttkrist reserves the right to modify this Policy at its sole discretion. Any changes will take effect upon posting on our website. Customers are encouraged to review this Policy periodically for updates.
